HB 20-1158 Summary

• All individual and group health benefit plans issued or renewed in Colorado must provide coverage for infertility diagnosis, treatment, and standard fertility preservation services, effective January 1, 2022.

• Coverage includes three completed oocyte retrievals with unlimited embryo transfers following American Society for Reproductive Medicine (ASRM) guidelines, using single embryo transfer when medically appropriate.

• Health plans cannot impose different exclusions, limitations, deductibles, copayments, or waiting periods on infertility coverage compared to other covered services.

• Religious employers may request exclusions from the infertility coverage requirement if it conflicts with their bona fide religious beliefs, provided they give employees reasonable notice.

• The Division of Insurance must submit to the federal Department of Health and Human Services a determination of whether this coverage constitutes an additional benefit requiring state defrayal under federal law; the law applies only upon federal confirmation that state defrayal is not required or after 365 days of federal non-response.
