HB 20-1195: Consumer Digital Repair Bill of Rights

• Requires manufacturers of digital electronic equipment (such as cell phones and tablets) to provide parts, software, tools, and documentation to independent repair providers and equipment owners on fair and reasonable terms.

• Manufacturers must provide documentation at no charge (except for actual printing costs) and offer other repair resources at terms equivalent to those offered to authorized repair providers.

• Manufacturers may redact trade secrets from documentation and withhold proprietary design information only if doing so does not diminish usability for repair purposes.

• Non-compliance with repair resource requirements is classified as an unfair or deceptive trade practice under Colorado law.

• Any contract provision that waives or limits a manufacturer's obligations under this act is void and unenforceable; the law takes effect January 1, 2021, subject to voter approval if a referendum petition is filed.
