HB20-1239: Vaccine Consumer Protection Act

• Requires health care providers to provide patients with written vaccination information including vaccine name, manufacturer, ingredients, risks and benefits, exemption rights, and liability limitations prior to administration.

• Mandates completion of a state board of health-created contraindication checklist for patients under 18 years of age before vaccine administration, addressing current health status, allergies, previous adverse reactions, and family medical history.

• Prohibits vaccine administration to minors without parental or guardian consent and bars health care providers, insurers, and schools from denying services or treating individuals differently based on vaccination status or decisions to delay/decline vaccines.

• Requires health care providers to report vaccine adverse events to the federal Vaccine Adverse Event Reporting System and record them in patient medical records.

• Establishes civil penalties up to $1,000 for first violations and up to $5,000 for subsequent violations, enforced by relevant state agencies and licensing boards after hearing procedures.
