HB 20-1275 Summary

• Requires the State Board for Community Colleges and Occupational Education to adopt and implement a policy by January 1, 2021 granting in-state tuition status at community colleges to active members and veterans of the U.S. Armed Forces and their dependents, regardless of Colorado domicile or residency status.

• Defines "dependent" as either a spouse of an active member or veteran (living or deceased) requesting in-state tuition, or a child under 23 years old born to or legally adopted by an active member or veteran (living or deceased).

• Specifies that individuals eligible for in-state tuition under this section are not counted as residents for any other purpose, except they remain eligible to receive stipends from the College Opportunity Fund.

• Applies exclusively to community colleges governed by the State Board for Community Colleges and Occupational Education as described in Section 23-60-205.

• Takes effect 90 days after final adjournment of the General Assembly (August 5, 2020), unless subject to a referendum petition filed by November 2020.
