Requires governmental entities (state, local, and special districts) that encrypt all radio communications to enact an encryption policy by January 1, 2021 (or before encryption if after that date).

Encryption policies must include access to unencrypted radio transmissions for members of the Colorado media, which may require media credential verification and reasonable restrictions on radio monitoring equipment use.

Encryption policies must include standards preventing unreasonable and burdensome limitations on public access to radio communications, and should consider delayed or real-time online transmission as alternative public access methods.

Governmental entities must seek input from Colorado media members and establish a public feedback process, including at least one public meeting, before enacting an encryption policy.

Act takes effect August 5, 2020, subject to referendum petition and voter approval in the November 2020 general election.
