HB 20-1302 Summary

• Adds "harmful act" definition to at-risk adult protection law covering acts causing harm to health, safety, or welfare when not classified as abuse, neglect, or exploitation

• Reduces reporting timelines from 48 hours to 24 hours for written reports of mistreatment and requires law enforcement to forward reports within one business day instead of 24 hours

• Requires county departments to provide employers and oversight agencies access to investigation records during mistreatment investigations, including patient/resident interviews, personnel records, and health records

• Allows disclosure of CAPS check information to employers and state oversight agencies when necessary to ensure safety of other at-risk adults under care

• Expands CAPS check requirements to include volunteers providing direct care and adds Office of Public Guardianship and state facilities for intellectual/developmental disabilities to covered employers
