• Changes the Colorado Open Meetings Law to clarify that elected officials exchanging (rather than using) electronic mail about pending legislation or public business are subject to open meetings requirements.

• Exempts electronic mail communication between elected officials from open meetings law if it does not relate to the merits or substance of pending legislation or other public business.

• Specifies that exempt communications include emails regarding scheduling and availability, forwarding information, responding to inquiries from non-members, or posing questions for later public discussion.

• Takes effect September 1, 2020, subject to a referendum petition filed within 90 days after final adjournment of the general assembly.

• Applies only to electronic mail communication sent on or after the effective date of the act.
