HB 20-1313 Summary

• County clerks must mail ballots to all eligible voters who register between the 15th and 8th day before an election, with ballots mailed within two business days of registration.

• County clerks must begin mailing all ballots by first-class mail on the 11th day before an election and deliver ballots to postal service within two business days of processing registration applications through the 8th day before an election.

• Eligible electors may request replacement ballots by the 8th day before an election if their original ballot was lost, destroyed, spoiled, or not received, but cannot receive a replacement if a ballot has already been received for that election.

• County clerks and certain other persons responsible for ballots must report to the secretary of state or county clerk if they have knowledge that ballots have been lost, stolen, or will not be timely delivered.

• Any person who knowingly and willfully fails to report lost, stolen, or late ballots is subject to a civil penalty not to exceed $50, with exemptions for election judges, county clerk staff, and individual postal workers.
