Prohibits retailers from selling flavored cigarettes, tobacco products, nicotine products, and flavor enhancers effective September 1, 2020.

Defines flavored products as those imparting a taste or smell other than tobacco, including fruit, menthol, mint, chocolate, vanilla, candy, dessert, alcohol beverage, herb, or spice flavors.

Establishes rebuttable presumption that products are flavored if retailer or manufacturer makes public claims, uses promotional labeling/signage, or takes actions indicating non-tobacco taste or smell.

Assigns enforcement authority to the Division of Regulation and implements escalating penalties within a 24-month period: $250 (first violation), $500 (second), $1,000 plus 7-day sales ban (third), $1,000-$15,000 plus 15-day sales ban (fourth), and $15,000 plus 1-year sales ban (fifth or subsequent violation).
