Executive director of the department of transportation must adopt rules by December 31, 2021 to establish a preferential access program for low-emission vehicles in managed lanes regardless of occupant count.

Rules may require annual enrollment fees, limit the total number of eligible vehicles, restrict eligibility duration to specific years after initial purchase, differentiate between vehicle classes, limit access to certain managed lanes, and allow free or reduced toll rates.

Low-emission vehicles are defined as motor vehicles weighing 26,000 pounds or less that are either zero-emission vehicles producing no criteria air pollutants or range-extended battery electric vehicles capable of more than 75 all-electric miles.

Managed lanes include high occupancy vehicle lanes, toll lanes, and high occupancy toll lanes.

Repeals the statutory authority for an existing low-emission vehicle program expiring May 31, 2020.
