HB 20-1405 Summary

• Imposes a $30 filing fee on persons commencing forcible entry and detainer (eviction) actions, effective July 1, 2020.

• All collected fees are deposited into the eviction legal defense fund to support civil legal services for indigent residents.

• Expands the fund to consist of collected filing fees plus any other money the General Assembly appropriates or transfers to it.

• Makes the state court administrator's authority to award grants from the fund subject to available appropriations.

• Declares the act necessary for immediate preservation of public peace, health, or safety.
