HB20-1409 Summary

• Expands the Colorado Department of Public Health and Environment's inspection authority to include facilities that house or detain noncitizens for civil immigration proceedings, including those operated by the Federal Office of Refugee Resettlement or U.S. Immigration and Customs Enforcement.

• Requires annual inspections of state institutions under the Department of Human Services and Department of Corrections, with additional unannounced inspections permitted after the annual inspection.

• Requires annual inspections of facilities housing noncitizens for immigration proceedings, with additional unannounced inspections permitted after the annual inspection.

• Mandates that facilities housing noncitizens as of September 1, 2020 must complete their first annual inspection by January 1, 2021, with inspection reports provided to the Governor and legislative Judiciary Committees by that date.

• Declares the act necessary for the immediate preservation of public peace, health, or safety.
