HB 20-1419 Summary

• Creates the HIV Medications Rebate Fund in the state treasury to receive money from pharmaceutical rebates for the state drug assistance program administered by the Department of Public Health and Environment.

• Fund consists of money received based on charges in excess of federal price agreements and any additional money the General Assembly appropriates.

• General Assembly shall continuously appropriate money from the fund to the Department of Public Health and Environment for use in the state drug assistance program.

• Any money remaining in the fund at the end of a fiscal year remains in the fund and shall not be transferred to the general fund or any other fund.

• Fund is exempt from the limit on uncommitted reserves in cash funds established in Colorado Revised Statutes Section 24-75-402(3).
