Department of Public Health and Environment shall seek EPA approval to replace the on-board diagnostics test with an IM240 tailpipe emissions test, except where the tailpipe test cannot be safely conducted.

Department must submit the proposed state implementation plan (SIP) revision to the air quality control commission by September 31, 2020, the commission must adopt it by December 31, 2020, and the EPA must receive it by May 5, 2021.

Before submitting the proposal to the commission, the department must provide written comment opportunities and hold a stakeholder meeting with emissions inspectors, vehicle owners, legislators, manufacturers, and air quality experts.

The provision automatically repeals if the EPA rejects the proposed SIP revision, with the director notifying the revisor of statutes of the rejection date.

Act takes effect 90 days after final adjournment of the general assembly (August 5, 2020) unless subject to a referendum petition requiring voter approval in November 2020.
