SB20-040 Summary

• Establishes the "Genetic Counselor Licensure Act" requiring licensure by the Director of the Division of Professions and Occupations effective June 1, 2021.

• Applicants must provide evidence of certification by the American Board of Genetic Counseling (ABGC) or American Board of Medical Genetics and Genomics (ABMGG), with provisional licenses available for active certification candidates.

• Restricts use of titles "genetic counselor," "licensed genetic counselor," and related terms to licensed practitioners only.

• Requires all genetic counselors to maintain professional liability insurance and comply with disciplinary standards including grounds for discipline related to sexual conduct, fraud, substance abuse, felony convictions, and violations of practice standards.

• Repeals the article effective September 1, 2027, subject to sunset review; genetic counselors are subject to medical transparency disclosure requirements.
