SB20-064 Summary

• Repeals Colorado Revised Statutes 6-4-107(3), which previously prohibited the state Attorney General from challenging mergers or acquisitions that had been reviewed by federal agencies under Section 7A of the Clayton Act

• Allows Colorado's Attorney General to challenge mergers and acquisitions under state antitrust law regardless of whether federal entities have reviewed them or allowed their waiting periods to expire

• Applies retroactively to mergers commenced on or after the effective date of the act

• Takes effect on August 5, 2020, unless a referendum petition is filed within 90 days of final adjournment, in which case voter approval at the November 2020 general election is required
