SB 20-077 Summary

• Establishes a physician-patient relationship between a child born alive during or after an abortion and the physician who performed or attempted the abortion

• Requires the physician to exercise the same degree of professional skill, care, and diligence to preserve the child's life and health as would be provided to any other child born alive at the same gestational age, including immediate transfer to a hospital

• Creates civil penalty of not less than $100,000 for violations, enforceable by the attorney general who may also recover reasonable attorney's fees

• Makes violations a class 3 felony and constitutes unprofessional conduct for licensing purposes

• Requires any person with knowledge of a failure to comply to report to the attorney general, with penalties of class 1 misdemeanor for failing to report; exempts the woman on whom the abortion was performed from liability
