SB 20-114: Uniform Registration of Canadian Money Judgments Act

• Establishes a uniform registration procedure for Canadian money judgments in Colorado district courts, allowing creditors to register judgments without filing a separate action for recognition.

• Requires registration documents to include an authenticated copy of the Canadian judgment, identification of parties, judgment amounts with accrued interest and costs, post-judgment fees, and a statement that the judgment is final and enforceable in Canada.

• Grants registered Canadian judgments the same effect as recognized foreign judgments, but enforcement by sale, seizure, or garnishment is prohibited for 35 days after notice of registration, allowing time for the defendant to petition to vacate.

• Permits the defendant to petition the court within 35 days to vacate the registration based on grounds that could deny recognition under Colorado's Foreign-Country Money Judgments Recognition Act or non-compliance with registration requirements.

• Takes effect July 1, 2021, subject to referendum petition, and supplements rather than replaces existing procedures for seeking recognition of Canadian judgments.
