SB20-128 Summary

• Expands authorization for broadband installation in electric easements to include electric generation and transmission cooperative associations, in addition to existing authorization for cooperative electric associations.

• Authorizes installation of new underground broadband facilities within electric easements held by these entities, subject to notice and procedural requirements.

• Requires at least 30 days' written notice by certified mail to property owners before broadband installation begins, with memorandum filing in county clerk and recorder offices.

• Limits liability for property owners' claims to 2 years from the date of notice, and prohibits recovery of appraisal costs, attorney fees, and special or punitive damages except in cases of non-compliance, negligence, or willful misconduct.

• Becomes effective August 5, 2020, unless subject to a referendum petition, in which case it requires voter approval at the November 2020 general election.
