• State Board of Education must create and post a FERPA waiver form on its website by July 1, 2021, allowing parents to consent to school-behavioral health provider communication for one school year.

• Public schools, charter schools, and school institutes must include the waiver form in pupil registration materials and collect signed forms annually at the start of each school year.

• Waiver form must clearly explain that signing is optional and allows school personnel to share student health records with behavioral health care providers.

• Each school district and charter school may develop its own waiver form or use the standardized form posted on the Department of Education's website.

• Act takes effect August 5, 2020, unless subject to referendum petition, in which case it requires voter approval at the November 2020 general election.
