Allows adoptive parents with adoption assistance agreements to pay out-of-pocket for medical services and items from providers not enrolled in the medical assistance program

Requires adoptive parents to determine that the child's special needs require services from a non-enrolled provider and enter into a documented agreement with the provider

Exempts such out-of-pocket payments from recipient payment limitations contained in sections 24-31-808 and 25.5-4-301 when adoptive parents consent to bear the costs

Makes adoptive parents liable for all costs of items or services obtained from non-enrolled providers under the documented agreement

Adoption assistance agreements must be reviewed at least every three years with written notice provided to the adoptive family
