Senate Bill 20-218 Summary

• Imposes a $25 per tank truckload fee on fuel product manufacturers and distributors from September 1, 2020 through September 30, 2026, excluding aviation fuel and odorized liquefied petroleum gas.

• Creates the Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) Cash Fund to receive fee revenues, with distributions to fund PFAS grant and takeback programs, support Department of Transportation hazardous materials functions, and support Colorado State Patrol highway hazardous materials regulation.

• Establishes a PFAS grant program allowing eligible entities to receive funding for water sampling, water system infrastructure treatment, and emergency community assistance related to PFAS contamination.

• Creates a PFAS takeback program allowing the Department of Public Health and Environment to purchase and properly dispose of materials containing PFAS, with published purchase prices for eligible materials.

• Requires annual reporting to the General Assembly through February 1, 2027 on fund amounts, grant awards, grantee actions, eligible materials purchased, and suggested policy changes; also establishes civil penalties for gasoline dispensing facility violations including failure to maintain vapor collection systems ($15,000 per day) and record-keeping violations ($5,000-$15,000).
