SB20B-009: Small Business Fairness Act

• Exempts businesses from orders by the Governor, Department of Health, or public health agencies requiring closure or limited operations due to declared emergencies, epidemics, or dangerous communicable diseases if the same products or services are available at an open business in the affected area.

• Requires the closed or limited business to comply with all safety precautions mandated for businesses allowed to continue operations in order to qualify for the exemption.

• Applies the exemption provision to both Colorado Revised Statutes Section 25-1-114 (general public health unlawful acts) and Section 25-1-516 (additional public health unlawful acts).

• Defines "order" to include notices, standards, rules, or regulations issued by the Department or public health agencies, as well as executive orders issued by the Governor.

• Declares the act necessary for immediate preservation of public peace, health, or safety.
