House Bill 21-1024 Summary

• Expands the definition of "off-highway vehicle" to include personal watercraft, defined as motorboats operated by a person sitting, standing, or kneeling on the vessel, powered by either an inboard water jet pump or outboard propeller.

• Extends the sales tax exemption for off-highway vehicle transfers between individuals (when neither is a dealer) from July 1, 2014 through July 1, 2023 to apply retroactively to vehicles first sold before July 1, 2014.

• Allows motor vehicle dealers and off-highway vehicle dealers to purchase untitled off-highway vehicles that were originally purchased before July 1, 2023 from private individuals or used exclusively for agricultural purposes on private land.

• Permits insurers, salvage pools, and vehicle dealers (including off-highway vehicle dealers) to access owner and lienholder information from the Department of Motor Vehicles for insurance claims and vehicle transactions, with a fee not to exceed $5 or direct/indirect costs.

• Appropriates $45,887 to the Department of Revenue and $53,422 to the Colorado State Patrol for the 2021-22 fiscal year to implement administrative and inspection requirements related to off-highway vehicle title transfers.
