HB21-1082 Summary

• Allows a prospective firearm transferee to satisfy background check requirements by presenting a valid Colorado concealed carry permit issued on or after the bill's effective date, in lieu of undergoing a National Instant Criminal Background Check System (NICS) search.

• Requires sheriffs to receive results of a federal background check prior to issuing or renewing a concealed carry permit, making Colorado permits eligible for federal recognition as an alternative to NICS background checks.

• Mandates the Colorado Attorney General contact the federal ATF by December 31, 2021, to request that Colorado concealed carry permits qualify as alternatives to federal background check requirements.

• Requires a transferee presenting a permit as a background check alternative to attest in writing that they have not been convicted of domestic violence, treated for a mental health condition, or otherwise become ineligible to possess a firearm since the permit's issuance.

• Establishes a Class 1 misdemeanor penalty for knowingly presenting an invalid or expired permit, or making false statements in the attestation, with permit revocation if the person holds a valid permit.
