HB 21-1084 Summary

• State shall reimburse county departments for costs paid to public or private driving schools to provide driving instruction to individuals in foster care aged 15-21 years old.

• County departments contracting with driving schools and injuries occurring during instruction are shielded from liability; governmental immunity under Article 10 of Title 24 is preserved.

• Guardians ad litem, county/district social services officials, and Division of Youth Services officials who sign driver's license applications without signing an affidavit of liability are not subject to personal or governmental liability for applicant negligence.

• State Department of Revenue shall promulgate rules by November 1, 2021 establishing alternative documentation forms to allow foster youth to verify legal U.S. residence and establish identity for driver's licenses without all standard required documents.

• $54,180 is appropriated to the Department of Human Services Division of Child Welfare for fiscal year 2021-22 to implement the act.
