HB 21-1106: Promoting Child Safety Through Responsible Firearm Storage Act

• Requires firearms to be responsibly and securely stored when not in use by carrying on person, using a locked safe or secure container, installing a locking device, or using a personalized firearm with activated safety features.

• Creates Class 2 misdemeanor offense for "unlawful storage of a firearm" when a person fails to secure a firearm knowing a juvenile can access it without permission or a resident ineligible to possess firearms lives on the premises.

• Mandates all licensed gun dealers provide a locking device with each firearm sold and post notice that unlawful storage may result in imprisonment or fine.

• Requires Department of Public Health and Environment to develop a firearms safe storage education campaign with website resources, materials for law enforcement and health care providers, and information about free or reduced-price locking devices.

• Effective July 1, 2021; excludes antique firearms and curios/relics from storage requirements; includes affirmative defense if juvenile used firearm for self-defense or livestock protection.
