HB21-1136 Summary

• Modifies Colorado Revised Statutes 24-51-1105 to allow judicial division retirees to return to temporary judicial duties without pay for 10, 20, 30, 60, or more than 90 days per year in exchange for benefit increases of 3.3%, 6.7%, 10%, 20%, or more than 30% respectively.

• Repeals the provision allowing retirees who did not pre-arrange agreements prior to retirement to enter into agreements within five years after retirement.

• Establishes three new eligibility restrictions: retirees cannot return to temporary duties if they received a "does not meet performance standard" or "do not retain" rating in their final performance evaluation, received any disciplinary disposition from the Commission on Judicial Discipline, or received private or public discipline from the Office of the Presiding Disciplinary Judge.

• Appropriates $723,564 from the general fund for fiscal year 2021-22, consisting of $71,738 for general courts administration (0.9 FTE), $51,825 for capital outlay, and $600,001 for the senior judge program to address COVID-19 pandemic caseload backlogs.
