House Bill 21-1140 Summary

• All individual and group health benefit plans issued or renewed in Colorado on or after January 1, 2022, must cover health care services related to living organ donation for covered persons who are living organ donors.

• Health benefit plans cannot impose deductibles, copayments, coinsurance, benefit maximums, waiting periods, or other coverage limitations on living organ donation services.

• Hospitals and other licensed health facilities cannot bill or charge living organ donors for any costs associated with providing health care services related to living organ donation, effective January 1, 2022.

• Health care services are defined as the procedure to harvest an organ and all services required before and after the procedure.

• The Insurance Commissioner must adopt rules to implement these requirements; $13,353 is appropriated to the Division of Insurance for 2021-22 to support implementation with 0.2 FTE.
