HB21-1159: Limitations On Regulated Marijuana Delivery

• Requires retail marijuana stores to be open at least 5 days per week and at least 5 hours per day to qualify for a marijuana delivery permit.

• Limits delivery sales to only retail marijuana, retail marijuana products, or branded merchandise that the store currently has available for in-store sale at the same prices.

• Prohibits online platforms from holding pre-paid accounts for licensed retail marijuana stores.

• Waives application and license fees for retail marijuana transporter applicants who meet social equity criteria established under section 44-10-308(4).

• Prohibits medical marijuana business operators and retail marijuana business operators from engaging in the delivery of regulated marijuana.
