HB21-1175 Summary

• Allows persons cited for or convicted of traffic infractions or traffic misdemeanors to donate money or time to a 501(c)(3) or 501(c)(4) nonprofit organization in lieu of paying fines

• Caps the amount of fine that may be offset through donation at $500

• For monetary donations, person must provide proof to the court equal to or greater than the penalty assessment and surcharge

• For time donations, person must provide a notarized statement from the nonprofit converting volunteer hours to monetary value using Colorado's statewide minimum wage, equaling or exceeding the penalty assessment and surcharge

• Applies to citations issued by state or local authorities on or after the effective date, subject to potential referendum petition approval by voters in November 2022
