• Allows medical marijuana cultivation facilities and products manufacturers to receive transfers of retail marijuana from co-located retail facilities with shared ownership and change the designation to medical marijuana after passing testing.

• Allows retail marijuana cultivation facilities and products manufacturers to transfer retail marijuana to co-located medical marijuana facilities with shared ownership and change the designation to medical marijuana.

• Marijuana that changes designation from retail to medical cannot be transferred back, redesignated as retail, or treated as retail marijuana going forward.

• No refunds of retail marijuana excise taxes apply to transfers and designation changes under this law.

• Requires the state licensing authority to submit a feasibility report by January 3, 2022 analyzing whether to allow designation changes from medical to retail marijuana, including economic impacts, production management impacts, and stakeholder perspectives; this reporting requirement expires July 1, 2022.
