Department of Personnel shall maintain an annual inventory of unused state-owned real property and post the list on its website, excluding parks, wildlife division property, land commissioners' property, and higher education institutions.

Department may determine suitability of unused state property for affordable housing, child care facilities, public school facilities, residential mental and behavioral health care facilities, or renewable energy facilities, with input from state architect, Department of Local Affairs, Colorado Housing and Finance Authority, and other experts.

Department may seek proposals from qualified developers to construct affordable housing, child care, schools, mental health facilities, or renewable energy on suitable unused state property in accordance with the Procurement Code, subject to Capital Development Committee approval.

Creates the Unused State-Owned Real Property Fund in the state treasury to receive proceeds from sales, rents, and leases of unused state property, with funds available for appraisals, surveys, property improvements, and administrative costs.

Contracts with developers may not require improvements on state property to become state property upon lease termination, and Department of Transportation property designated for affordable housing, child care, or renewable energy receives priority right of first refusal over other political subdivisions.
