HB21-1303: Buy Clean Colorado Act

• Establishes maximum acceptable global warming potential (GWP) limits for eligible materials used in Colorado public construction projects to reduce greenhouse gas emissions.

• Office of the State Architect must set GWP standards by January 1, 2024 for building projects (excluding roads, highways, and bridges) using asphalt, cement, concrete, glass, steel, and wood structural elements.

• Department of Transportation must establish GWP tracking policy by January 1, 2025 for road, highway, and bridge projects using asphalt, cement, concrete, and steel.

• Contractors must submit Type III Environmental Product Declarations meeting established GWP limits before installing eligible materials; waivers available if compliant products are not reasonably priced or available.

• Appropriates $75,342 to the Department of Personnel for 0.9 FTE to support the Office of the State Architect in implementing the act; standards must be reviewed every four years with adjustments only allowed to become more stringent.
