SB21-005: Small Business Fairness Act

• Creates exemption allowing businesses to continue or resume operations despite closure orders from the Governor, Department of Public Health, or public health agencies during declared emergencies, epidemics, or dangerous communicable diseases.

• Requires that products or services offered by the closed business be available at another business in the same geographical area that has not been required to cease operations.

• Mandates that the business seeking exemption must comply with all safety precautions required by the applicable closure order.

• Amends Colorado Revised Statutes sections 25-1-114 and 25-1-516 to add these exemption provisions and define "order" and "public health agency."

• Includes a safety clause declaring the act necessary for immediate preservation of public peace, health, and safety.
