SB21-031 Summary

• Prohibits state, county, city and county, or local government agencies and their agents from ordering protesters to disperse or deeming a protest unlawful unless a significant number of participants pose an imminent threat to use force or violence to cause personal injury or significant property damage.

• Requires law enforcement and government officials to make every effort to differentiate between protesters engaging in violence or escalation and those continuing peaceful, lawful assembly.

• Mandates that persons engaged in peaceful, lawful assembly must be allowed to continue their activities without interruption.

• Takes effect 12:01 a.m. on the day following the 90-day period after final adjournment of the general assembly, unless a referendum petition is filed, in which case it requires approval by voters at the November 2022 general election.
