• Third-party food delivery services are prohibited from taking orders from or arranging delivery/pickup from retail food establishments without the establishment's prior written consent.

• "Retail food establishment" applies to licensed food establishments but excludes grocery stores and convenience stores.

• Retail food establishments can sue delivery services for violations in court, seeking damages, civil penalties up to $1,000 per violation, and injunctive relief, with prevailing parties entitled to reasonable attorney fees.

• The act takes effect 90 days after final adjournment of the general assembly, unless subject to a referendum petition that requires voter approval in November 2022.
