Senate Bill 21-040 Summary

• Prohibits Colorado occupational regulators from considering driver's history records (traffic violations, moving violations, etc.) when issuing, renewing, or reinstating professional licenses, certifications, or registrations, with limited exceptions.

• Allows consideration of driver's history events only if: the event is relevant to the profession/occupation being licensed, AND either motor vehicle operation is a job duty, the event is part of a pattern of relevant behavior, OR the event occurred within 3 years before application.

• Prohibits regulators from using driver's history to impose discipline on existing license, certification, or registration holders, except under the same three conditions listed above.

• Explicitly excludes misdemeanor and felony convictions from the definition of "driver's history" for purposes of this law, allowing those to be considered separately under existing criminal conviction provisions.

• Takes effect 90 days after final adjournment of the general assembly, subject to potential referendum petition and voter approval.
