• Creates a new crime of retaliation against an elected official in Colorado, classified as a Class 6 felony, applicable to any person serving in an elected position at any level of government.

• Defines retaliation as knowingly making a credible threat as retaliation or retribution against an elected official, their family member, someone in close relationship to them, or a household member.

• Defines "credible threat" as a threat, physical action, or repeated conduct that would cause a reasonable person to fear for safety, including threats not directly expressed if the totality of conduct creates such fear.

• Appropriates $109,462 from the Capital Construction Fund to the Corrections Expansion Reserve Fund for fiscal year 2021-22, with additional appropriations of $16,279 (2022-23) and $18,415 annually (2023-24 through 2025-26) for implementation.

• Takes effect July 1, 2021, and applies to offenses committed on or after that date.
