SB 21-077 Summary

• Eliminates requirement to verify lawful U.S. presence for educator license applications to the Department of Education; applicants must provide name, address, and either social security number, individual taxpayer identification number, or another identity-verifying document.

• Removes lawful presence verification requirement for professional and commercial licenses issued by the Department of Regulatory Agencies; applicants without social security numbers may substitute individual taxpayer identification number or other identity document as determined by the applicable division, board, or agency.

• Repeals lawful presence verification requirements for county and municipal business licenses and authorizations.

• Exempts applicants for regulated profession and occupation licenses (including child care providers and facilities) from lawful presence verification requirements under state law 8 U.S.C. sec. 1621(d).

• Takes effect at 12:01 a.m. on the day following the 90-day period after final adjournment of the general assembly, or if subject to referendum petition, upon approval by voters at the November 2022 general election.
