Senate Bill 21-080 Summary

• Entities are protected from COVID-19-related liability unless a claimant proves by clear and convincing evidence that exposure, loss, damage, injury, or death resulted from the entity's failure to comply with public health guidelines.

• Liability exceptions exist for gross negligence or willful and wanton acts or omissions by the entity.

• Public health guidelines include all applicable official guidelines, instructions, orders, and mandates issued by the Governor, Colorado Department of Public Health and Environment, or other government agencies.

• Entities covered include individuals, corporations, government agencies, educational institutions, religious organizations, businesses, trusts, and other legal entities.

• The statute automatically repeals two years after the Governor or General Assembly terminates the state of disaster emergency declared on March 11, 2020.
