Allows small group health benefit plans to remain regulated under small group rules even after an employer grows to more than 100 employees, as long as the employer continues renewing the same or similar plan with the carrier.

Requires carriers to offer employers the same small group health benefit plan upon renewal, or if that plan is no longer offered to any small employer, a similar small group plan the carrier offers to other small employers.

Mandates carriers notify employers within 60 days of discovering they employ more than 100 eligible employees, but no later than the plan anniversary date, that small group regulatory protections will end if they fail to renew their current plan or switch to a different plan.

Takes effect 12:01 a.m. on the day following the 90-day period after the general assembly's final adjournment, unless subject to a referendum petition.
