SB21-186 Summary

• Repeals prohibition on ticket resale restrictions and instead requires resellers to possess tickets or have written contracts to obtain them before advertising, offering for sale, or accepting payment for resales.

• Permits event operators to apply terms or conditions to original ticket sales that limit transferability and resale rights, including restrictions on subscription or season ticket packages.

• Requires resellers to guarantee full refunds if events are canceled, tickets are counterfeit, tickets fail to grant admission, or tickets do not match advertised descriptions.

• Adds two deceptive trade practices for online ticket sales: displaying trademarked or copyrighted URLs, titles, images, or symbols without written consent, and operating websites substantially similar to operator websites without written consent.

• Takes effect 90 days after final adjournment of the general assembly, unless a referendum petition is filed, in which case it requires voter approval at the November 2022 general election.
