HB22-1015 Summary

• Physicians, physician assistants, advanced practice registered nurses with prescriptive authority, and pharmacists may prescribe and dispense FDA-approved therapeutic drugs for off-label use to treat or prevent COVID-19, including hydroxychloroquine sulfate and ivermectin.

• Off-label prescribing for COVID-19 prophylaxis does not require evidence of suspected exposure to the virus, and at-home early-stage treatment does not require a COVID-19 test.

• Prescribing or dispensing off-label drugs in compliance with this act is not considered unprofessional conduct and cannot be grounds for disciplinary investigation or action by medical regulators.

• The bill does not limit or affect the existing prescriptive authority of healthcare providers.

• The act applies to conduct occurring on or after its effective date and includes a safety clause declaring it necessary for immediate preservation of public peace, health, or safety.
