CO HB1020

Prohibits state agencies from promulgating or enforcing rules that limit or prohibit installation or use of natural gas, propane, solar photovoltaics, micro wind turbines, or small hydroelectric power systems in residences or businesses for electricity generation, cooking, hot water, or space heating.

Prohibits local governments from enacting or enforcing ordinances, resolutions, regulations, or other laws that limit or prohibit the same energy systems and appliances in residences or businesses.

Prohibits homeowner associations from limiting or prohibiting installation or use of these energy systems and appliances within individual units, notwithstanding any contrary provisions in association declarations, bylaws, or rules.

Defines micro wind turbines and micro hydroelectricity as systems with maximum capacity of 100 kilowatts or less.

Takes effect 12:01 a.m. on the day following the 90-day period after final adjournment of the general assembly, subject to possible referendum petition and approval by voters in November 2022.
