HB 22-1041 Summary

• Expands the definition of "protected persons" eligible for personal information removal from public internet records to include code enforcement officers, child representatives, health-care workers, animal protection officers, and Office of Respondent Parents' Counsel staff members.

• Requires protected persons requesting removal of personal information from online government records to submit their full name, home address, evidence of protected status, and an affirmation under penalty of perjury that disclosure poses an imminent and serious threat to safety.

• Allows "exempt parties" (real estate transaction participants, title companies, mortgage servicers, and licensed attorneys) to access otherwise-redacted personal information in county records if they provide evidence and an affirmation of their exempt status.

• Authorizes county recorders, assessors, and treasurers to use existing processes or establish new procedures to grant exempt parties access to redacted records and to assess administrative costs for such access.

• Declares the act necessary for immediate preservation of public peace, health, and safety.
