HB22-1064 Summary

• Prohibits retailers from selling, advertising, or displaying flavored cigarettes, tobacco products, and nicotine products (including flavors such as menthol, mint, fruit, chocolate, and candy) effective January 1, 2024, with exemptions for flavored pipe tobacco and premium cigars.

• Bans distribution of synthetic nicotine products (nicotine derived from non-tobacco sources) and expands the definition of tobacco products to include those containing synthetic nicotine effective January 1, 2024.

• Allows cigar-tobacco bars within licensed gaming establishments to sell menthol cigarettes limited to one carton per person per day.

• Imposes the same penalties for selling flavored products as apply to unlawful sales to minors, enforceable only against retailers and not consumers.

• Directs the Prevention Services Division to create a grant program providing $10 million in 2-year grants to communities disproportionately impacted by tobacco and nicotine marketing, sales, and use, with grants requiring evidence-informed wrap-around services.
