HB22-1073 Summary

• The director of the funeral regulatory board may contract with private parties to perform inspections of funeral establishments and crematories.

• The director or contracted private inspectors may enter funeral establishments or crematories with full right of ingress and egress during business hours to conduct inspections.

• All funeral establishments registered under section 12-135-110 and crematories registered under section 12-135-303 are deemed to have consented to inspections authorized by this bill as a condition of registration.

• Section 12-20-403 applies to investigations, hearings, and other proceedings conducted under this inspection authority.

• The act takes effect 90 days after final adjournment of the general assembly, unless a referendum petition is filed, in which case voter approval at the November 2022 election is required.
