HB22-1086 Summary: The Vote Without Fear Act

• Prohibits openly carrying firearms within polling locations, drop boxes, and within 100 feet of buildings containing polling locations or drop boxes on election days and during voting periods.

• Prohibits openly carrying firearms within central count facilities and within 100 feet of buildings containing central count facilities during ongoing election administration activities.

• Exempts peace officers acting in their official capacity, uniformed contract security guards, and private property owners carrying firearms on their own property or traveling directly between private property and outside the buffer zone.

• Violations are misdemeanors punishable by up to $1,000 fine and/or up to 364 days in county jail; first offenses limited to $250 fine and/or up to 120 days imprisonment.

• Requires designated election officials to visibly post signs notifying the public of the 100-foot no open carry zones for firearms.
