House Bill 22-1132 Summary

• Establishes the "Darcy's Last Call Act" requiring persons conducting controlled burns on private non-agricultural property to provide advance notice to local dispatch centers, county sheriffs, and applicable fire departments with date, time, location, and contact information.

• Defines "controlled burn" to include burns for farming/livestock production, clearing native vegetation, killing weeds, controlled ditch burns (excluding irrigation ditches), noncommercial trash burning, and open burning of slash piles.

• Allows fire departments to require their personnel be on standby during controlled burns and does not exempt persons from complying with other applicable local, state, or federal laws.

• Transfers $100,000 from the state general fund to the Local Firefighter Safety and Disease Prevention Fund for need-based grants to volunteer fire departments, with this provision repealing effective January 1, 2025.

• Takes effect 90 days after final adjournment of the general assembly unless subject to a referendum petition, in which case approval by voters in November 2022 is required.
